Firm Profile

Cohen & Buckley, LLP, a six lawyer firm, concentrates its practice primarily on complex litigation. The Firm maintains offices in Baltimore, Columbus, London and San Diego.

The Firm's partners have known and worked with each other over a long period of time. They have practiced in large, multi-city national and international law firms. Those partners have brought their skills and experience together to form a litigation Firm that is focused, well financed, supported technologically, and aggressive.

The partners collectively have decades of intensive experience in adversary proceedings. We have appeared throughout the United States in federal and state courts, both on the trial and appellate levels.

The Firm's practice is international in scope with extensive experience in international discovery, Hague Convention issues, and transnational insolvency law. We have been involved in cases involving parties and witnesses from every populated continent.

The Firm staffs each case on a team basis consisting at minimum of a partner and another lawyer of appropriate experience for the matter. In more complex matters, the Firm may field a team consisting of two or more partners and several other lawyers and paraprofessionals. In deciding on how to staff a case, we consider the complexity of the matter, the number of tasks that need to be done and the time frame within which they must be accomplished. Where appropriate, litigation functions are automated in order to permit the most efficient and cost effective means of presenting our client's position. We maintain a data base in each case capable of organizing and searching all evidence and documents.

The partner in charge of a case takes considerable care in case planning from the outset. After an initial analysis of the issues, the partner plans discovery and motions practice, and considers what the team will need to present the case before the tribunal. As each matter proceeds, the partner in charge refines the case plan so that the case proceeds in a comprehensive and orderly way. Through the use of paralegals and advanced technological systems of data retrieval, electronic communication and litigation management, we have successfully litigated cases against and on behalf of some of the largest corporations and financial institutions in the United States.

After completing an initial analysis of each matter, the Firm consults with its client to discuss staffing, the case plan, and a strategy for resolution. Usually, the starting point for this discussion is a comprehensive first report followed up by further communications with the client. We continually seek each client's comments as to staffing and resolution strategy at important junctures. The Firm's reporting usually proceeds on an approximately quarterly basis, but we are prepared to meet any specified reporting requirements and also to report on a more informal basis if the client desires.

Once a resolution strategy is agreed, we proceed to take all essential steps to achieve the desired objectives. In most cases, the Firm will seek to resolve the matter at the earliest possible time. While recognizing that most often summary disposition or early settlement is optimal, some matters are best resolved through final adjudication. If a matter needs to proceed to trial or hearing, we are fully prepared to take a case to verdict or final adjudication and routinely undertake representation before a range of tribunals.

Given our breadth of litigation experience, the Firm is well prepared to handle all evidentiary aspects of any case from scientific and demonstrative evidence to document intensive commercial transactions. We regularly consult with technical experts on a variety of matters and are well acquainted with the scientific and economic literature in several areas in which we practice. In addition, much of the Firm's work consists of document intensive cases. The Firm has developed stringent document handling procedures and database protocols for facilitating document retrieval in discovery and at trial. The Firm also uses computer graphics and video presentations extensively in the presentation of its cases.

We look forward to collaborating with each client as to the client's requirements for case handling and reporting. The Firm has adapted to different reporting format requirements and has on several occasions developed customized formats for the purposes of particular cases. The Firm insures that the same professionals staff each case to completion and encourages clients to communicate as frequently as they wish with regard to the progress of each matter.

Our Firm presents clients with a depth of experience both in substantive legal areas and litigation generally. Our size allows us to be flexible and responsive to clients' needs. We are pleased to discuss any particular requirements of representation that a client or potential client may have and endeavor to provide clients with excellent representation, while at the same time offering a close working relationship with the particular lawyers involved with the handling of each client's matters.
